Terms and Conditions for Online Trainings
Version: 13 October 2026. This English version is provided for convenience; in case of doubt the German version applies.
1. Scope
These terms apply to all bookings of live online trainings via trainings.christianemoser.at with CUXpro | Dipl.-Ing. Dr. Christiane Moser, Josef-von-Eichendorff-Straße 17, 5020 Salzburg, Austria (the “Organiser”). They apply to consumers within the meaning of the Austrian Consumer Protection Act (KSchG) as well as to businesses. Deviating terms of the customer do not become part of the contract.
2. Service
The booking covers participation in a live online training via the video conferencing platform Zoom on the booked date. Content, duration, language and maximum number of participants follow from the respective training description and the chosen date. The trainings are not recorded. Accompanying materials are provided by e-mail afterwards.
Each booked seat is personal and non-transferable: it entitles only one named person to attend. This also applies when several seats are booked together (e.g. for a team); each seat is assigned to a separate person. The access details are personal and must not be passed on to anyone else. The attending person can only be changed by naming a substitute under section 7.
3. Booking and conclusion of contract
The presentation of the trainings on the website is not a binding offer but an invitation to book. By completing the payment process via the payment provider Stripe you submit a binding offer. The contract is concluded when the Organiser confirms the booking by e-mail. For payment methods with delayed settlement (e.g. SEPA direct debit) the confirmation is sent once the payment has arrived. The contract language is German or English, according to the language of the website you used.
4. Prices and payment
All prices are in euro. For consumers the stated prices are final prices including the statutory VAT of the country of residence. Businesses from other EU member states that enter a valid VAT ID during checkout receive an invoice without Austrian VAT (reverse charge). Payment is made via Stripe with the payment methods offered there (e.g. credit card, PayPal, SEPA direct debit). The invoice is delivered electronically by e-mail.
5. Technical requirements
To participate you need an internet-enabled device with a stable connection, speakers or headphones, a microphone and ideally a camera, as well as the Zoom client or an up-to-date browser. The customer is responsible for the technical requirements on the participant’s side.
6. Cancellation or rescheduling by the Organiser
Trainings take place with a minimum of three participants. If a date has to be cancelled for good cause (e.g. too few participants, illness, technical failure), participants are informed by e-mail without delay and may either switch to a replacement date free of charge or receive a full refund. Further claims are excluded.
7. Rebooking, substitutes and no-show
Up to 48 hours before the start of the booked date you may switch free of charge to another offered date of the same training or name a substitute participant by e-mail to trainings@christianemoser.at. In case of no-show or later cancellation there is no entitlement to a refund; the statutory right of withdrawal for consumers (section 8) remains unaffected.
8. Right of withdrawal for consumers
Withdrawal notice. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (CUXpro | Dipl.-Ing. Dr. Christiane Moser, Josef-von-Eichendorff-Straße 17, 5020 Salzburg, Austria, e-mail: trainings@christianemoser.at) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early start and expiry of the right of withdrawal. If the booked date lies within the withdrawal period, the service starts before the end of the withdrawal period at your express request (consent given when booking). If you withdraw after the service has started but before the training has been fully performed, you shall pay an amount proportionate to the service provided until the withdrawal. The right of withdrawal expires once the training has been fully performed (section 18 para. 1 no. 1 of the Austrian Distance and Off-Premises Contracts Act, FAGG).
Model withdrawal form. If you want to withdraw from the contract, please fill in this form and return it to: CUXpro | Dipl.-Ing. Dr. Christiane Moser, Josef-von-Eichendorff-Straße 17, 5020 Salzburg, Austria, trainings@christianemoser.at. I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*): … Ordered on (*): … Name of consumer(s): … Address of consumer(s): … Date: … (*) Delete as appropriate.
9. Copyright
All training content and materials are protected by copyright. They may be used for the participants’ own purposes. Recording, reproduction or passing on to third parties is not permitted without the Organiser’s written consent.
10. Liability
The Organiser is liable for damages only in case of intent or gross negligence; this does not apply to personal injury or to claims under the Product Liability Act. No liability is assumed for disruptions of the internet connection or of the Zoom platform outside the Organiser’s control. Training content is delivered to the best of the Organiser’s knowledge; liability for the commercial success of its implementation is excluded.
11. Data protection
Information on the processing of personal data in connection with your booking can be found in the privacy policy.
12. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing in the EU this choice of law applies only insofar as it does not override mandatory consumer protection provisions of the country of residence. The place of jurisdiction for businesses is Salzburg. The Organiser is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. EU online dispute resolution platform: ec.europa.eu/consumers/odr (opens in a new tab).
